Please read these Terms of Service ("Terms") carefully before using the Buddy Beacon mobile application (the "App") operated by The Buddy Beacon, LLC ("we," "our," or "us").

## 1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

## 2. Description of Service

Buddy Beacon is a location-sharing application that allows users to:


    - Create and join groups with friends and family

    - Share real-time location with group members

    - Use color signals to communicate status

    - View group members on a shared map



## 3. Account Registration

To use the App, you must:


    - Be at least 13 years of age

    - Provide accurate and complete registration information

    - Maintain the security of your account credentials

    - Notify us immediately of any unauthorized access


You are responsible for all activities that occur under your account.

## 4. Acceptable Use

You agree NOT to use the App to:


    - Track or monitor anyone without their knowledge and consent

    - Harass, stalk, or intimidate others

    - Share location information of others without their permission

    - Violate any applicable laws or regulations

    - Interfere with or disrupt the App's functionality

    - Attempt to gain unauthorized access to our systems

    - Use the App for any illegal or harmful purpose



## 5. Location Services

The App requires access to your device's location services to function. By using the App, you:


    - Consent to the collection and sharing of your location with group members

    - Understand that location accuracy depends on your device and environment

    - Can disable location sharing at any time through App or device settings



## 6. User Content

You retain ownership of content you submit (profile photos, messages). By submitting content, you grant us a license to use, store, and display it as necessary to provide the App's services.

You are responsible for ensuring your content does not violate any third-party rights or applicable laws.

## 7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

## 8. Intellectual Property

The App and its original content, features, and functionality are owned by The Buddy Beacon, LLC and are protected by copyright, trademark, and other intellectual property laws.

## 9. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may delete your account at any time through the App settings.

## 10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT:


    - The App will be uninterrupted or error-free

    - Location data will be accurate at all times

    - The App will meet your specific requirements



## 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BUDDY BEACON, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:


    - Loss of data or privacy

    - Personal injury or property damage

    - Any damages arising from your use or inability to use the App



## 12. Indemnification

You agree to indemnify and hold harmless The Buddy Beacon, LLC from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

## 13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
